1. Agreement to terms

These Terms of Service (“Terms”) form a legally binding contract between you and CRDevelopment OÜ (“Company,” “we,” “our,” “us”) governing your use of the AI Web Auditor website and services (“Services”). By accessing or using the Services you accept these Terms.

2. Description of service

AI Web Auditor provides automated website analyses using artificial intelligence to assess:

• Search-engine optimisation (SEO) factors
• User-experience (UX) and accessibility
• Performance and Core Web Vitals
• Content quality and structure
• Multi-page navigation and site architecture

3. User accounts & registration

3.1 Account creation

You must create an account with accurate, complete information. Keep your credentials confidential.

3.2 Account responsibilities

• You must be at least 18 years old.
• You are responsible for all activity under your account.
• Notify us immediately of unauthorised access.
• Do not share your credentials.

4. Acceptable-use policy

4.1 Permitted uses

Use the Services only for lawful purposes. You may analyse sites you own, manage or have explicit permission to audit.

4.2 Prohibited activities

• Auditing sites without proper authorisation
• Using the Services for competitive analysis without consent
• Reverse-engineering or attempting to bypass security
• Submitting malicious URLs or overloading the platform
• Violating any law or third-party IP rights

4.3 Export-control compliance

You may not use the Services if you are located in or a resident of an embargoed or sanctioned country, or if you are listed on any applicable sanctions list.

5. Payment terms

5.1 Pricing

Services are sold via a credit system.

5.2 Payment processing

• Payments are handled securely by Stripe.
• All fees are non-refundable unless required by law.
• Credits do not expire but cannot be transferred.
• You must provide valid payment information.

5.3 Refund policy

Refunds for technical failures preventing audit completion may be granted at our discretion if requested within 30 days of purchase.

5.4 Taxes

Fees are exclusive of taxes, levies and duties. You are responsible for all taxes arising from your purchase, other than taxes based on our net income.

6. Intellectual-property rights

6.1 Our IP

The software, algorithms, reports, text, graphics and other content that power AI Web Auditor are owned by CRDevelopment OÜ or its licensors and are protected by copyright, trade-secret and other intellectual-property laws. Except for the limited rights expressly granted in these Terms, we reserve all rights, title and interest.

6.2 Your content

You retain ownership of the websites and materials you submit. You grant us a limited licence to access, analyse and store that content solely to provide the Services and generate audit reports.

6.3 Licence to audit reports

We grant you a perpetual, worldwide, non-exclusive licence to use, reproduce and distribute the audit reports you generate for your internal business purposes.

6.4 Feedback

If you provide suggestions, ideas or feedback, you grant us an unlimited, irrevocable licence to use that feedback for any purpose without compensation.

7. Data & privacy

Our collection and use of personal information is governed by our Privacy Policy, incorporated here by reference. We employ appropriate safeguards but you acknowledge the inherent risks of internet-based services.

8. Service availability, limitations & changes

8.1 Availability

We aim for high uptime but do not guarantee uninterrupted access; downtime may occur for maintenance or technical reasons.

8.2 Limitations

• Accuracy depends on website accessibility and structure.
• Some sites may be incompatible with our tools.
• Results are informational and not professional advice.
• We may enforce fair-use limits.

8.3 Modification of the service

We may add, modify or discontinue features at any time. Where a change materially reduces core functionality, we will provide reasonable notice.

9. Disclaimers & warranties

9.1 No warranties

The Services are provided “as is” without warranties of any kind, whether express, implied or statutory.

9.2 Results disclaimer

Audit results are algorithmic assessments; we do not guarantee particular outcomes from implementing our recommendations.

10. Limitation of liability

To the fullest extent permitted by law, CRDevelopment OÜ will not be liable for:

• Indirect, incidental, special or consequential damages
• Loss of profits, data or business opportunities
• Damages arising from use or inability to use the Services
• Any amount exceeding the fees you paid for the Services in the preceding 12-month period

11. Indemnification

You agree to indemnify and hold harmless CRDevelopment OÜ from claims or damages arising out of your use of the Services, violation of these Terms, or infringement of third-party rights.

12. Termination

12.1 By you

You may terminate your account at any time via the dashboard or by contacting support. Unused credits are non-refundable.

12.2 By us

We may suspend or terminate your account immediately for violation of these Terms, illegal activity or conduct that harms the Services or other users.

13. Governing law & disputes

These Terms are governed by the laws of Estonia. Any dispute will be resolved by binding arbitration seated in Tallinn, Estonia, under the Arbitration Rules of the Estonian Chamber of Commerce and Industry. Either party may bring a qualifying claim in small-claims court.

Before arbitration, the parties will attempt in good faith to resolve the dispute through direct negotiation for 30 days.

14. Changes to these terms

We may update these Terms at any time by posting the revised version. Material changes will be notified via email or in-app message. Continued use of the Services after the effective date constitutes acceptance.

15. Miscellaneous

15.1 Entire agreement

These Terms and the Privacy Policy constitute the entire agreement between you and CRDevelopment OÜ regarding the Services.

15.2 Severability

If any provision is unenforceable, the remaining provisions will continue in full force.

15.3 Force majeure

We are not liable for failure to perform due to causes beyond our reasonable control, including natural disasters, war, pandemic, government actions or third-party service failures.

15.4 Survival

Sections 5, 6, 7, 9-11, 13 and 15 survive termination of the agreement.
